IMPHAL, May 7: The Supreme Court has fixed first week of July for hearing the writ petition filed by Congress MLA DD Thaisii for upholding the September 18, 2020 order of the High Court of Manipur which declared Manipur Parliamentary Secretary (Appointment, Salary and Allowance & Miscellaneous Provision) Act 2012 and Manipur Parliamentary Secretary (Appointment, Salary and Allowance & Miscellaneous Provision) Act 2018 as unconstitutional.
The writ petition filed by DD Thaisii was listed for hearing before a double bench of the Supreme Court along with a special leave petition filed by State of Manipur and Leishangthem Susindro against Surjakumar Okram and others.
The special leave petition filed by the State of Manipur and Leishangthem Susindro prayed for exemption from filing certified copy of the impugned judgment order.
The double bench after perusing the case listed the matters for hearing in the first week of July.
It may be noted that the High Court of Manipur on September 18, 2020 had a judgment order which categorically stated that the Manipur Parliamentary Secretary (Appointment, Salary and Allowances & Miscellaneous Provision) Act 2012 and the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision)  Repealing Act 2018 were unconstitutional.
The High Court also made it clear that the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Repealing Act 2018 was invalid.
Notably, the 12 MLAs who were appointed as Parliamentary Secretaries are L Susindro (Khurai AC), N Indrajit (Kshetrigao AC), L Rameshwor (Keirao AC), Th Satyabrata (Yaiskul AC), H Dingo (Sekmai AC), Dr S Ranjan (Konthoujam AC), S Subashchandra (Naoriya Pakhanglakpa AC), K Robindro (Mayang Imphal AC), Leishiyo Keishing (Phungyar AC), Khasim Vashum (Chingai AC), Awangbow Newmai (Tamei AC) and Asab Uddin (Jiribam AC).
