Court sanctions custodial interrogation

IMPHAL, Nov 14: The Special Judge, NIA Manipur today accepted an application filed by the Chief Investigation Officer, NIA Imphal Branch for custodial interrogation of one Khangembam Sanjoy alias Athoi in connection with a case re-registered by NIA for actively working for banned underground outfits.
Through a Special PP, the Chief Investigation Officer submitted that as per the directive of the Ministry of Home Affairs, NIA Imphal Branch re-registered a case based on an FIR registered at Bishnupur police station against two persons who were arrested on June 24 this year while trying to pick up a lady for sending her to Moreh for recruitment as a cadre of a banned underground outfit under an instruction from the outfit’s publicity secretary.
During the investigation, it was revealed that the present accused Khangembam Sanjoy has been actively working for banned underground outfits for the purpose of recruitment, raising funds for the outfits and also involved in other unlawful activities, and is closely associated with the prime accused of the case, the outfit’s publicity secretary.
The accused was formally arrested on November 1 from Manipur Central Jail Sajiwa by NIA in connection with the case.
While the accused was in their custody, he complained  about health issues and was immediately taken to hospital. As the doctor of the hospital recommended surgical operation, the accused was remanded in judicial custody without any interrogation, the Special PP said.
As the accused has been discharged from hospital, custodial interrogation of the accused is highly required to unearth the larger conspiracy in which he was involved.
The Court, on perusal of the case record and after hearing the submission of the IO and the defence counsel, accepted the application filed by NIA for custodial interrogation of the accused.
The Court allowed NIA to carry out custodial interrogation of the accused from November 15 to November 18 from 11 am to 4 pm and also directed the SP, Manipur Central Jail Sajiwa to carry out judicial interrogation during specified period of time.
Notably, the alleged accused was earlier arrested four times from 2012 onward for being members of different underground outfits and was slapped NSA before he was arrested on September 12, 2022 by Imphal East commandos from Takhel village.
He was then taken into the custody of Imphal East women police station allegedly for raping a minor girl at gun point along with co-accused Leishangthem Khomei somewhere in Imphal East district and remanded in judicial custody on Sept 22.
One of the banned underground outfits had also announced capital punishment for both Khangembam Sanjoy and co-accused Leishangthem Khomei in a press release issued on September 21 for committing the heinous crime against the minor victim.
