SC issues notice to MLA

IMPHAL, Dec 11 : A double bench of the Supreme Court has issued notice to the sitting MLA of Naoriya Pakhanglakpa Assembly Constituency S Kebi in connection with the civil appeal filed by former MLA Soibam Subhaschandra.
The notice was issued on December 8 and is returnable within four weeks.
Soibam Subhaschandra had previously filed an election petition before the High Court of Manipur, challenging the election of S Kebi.
The petition, however, was dismissed by a single bench of the High Court on November 5, on the ground that it lacked merit.
Subhaschandra then filed a civil appeal before the Supreme Court.
The appeal was listed for hearing before the double bench of the Supreme Court, comprising Justice Vikram Nath and Justice Sandeep Mehta, on December 8.
During the hearing, the bench heard arguments from the counsels representing Soibam Subhaschandra.
After considering the submissions, the bench issued notice to the respondent, S Kebi, and other parties, with the returnable date set for four weeks.
It is worth noting that on November 5, the High Court of Manipur had dismissed the election petition filed by Soibam Subhaschandra against S Kebi, citing that the petition was not maintainable and lacked merit.
The election petition was filed by Subhaschandra in 2022, following the declaration of the results of the 12th Manipur Legislative Assembly elections, where S Kebi was declared elected from Naoriya Pakhanglakpa Constituency.
In his petition, Subhaschandra alleged several discrepancies in the election affidavit submitted by S Kebi, including false information about her age, educational qualifications, and non-disclosure of assets.
Specifically, the petition claimed that S Kebi had not disclosed her original name, as recorded in the school records and in the Board of Secondary Education Manipur records, which is "Sagolshem Sonalika Devi."
