Rape convict gets 20 years RI for aggravated sexual asault

IMPHAL, Dec 15: A fast track Court has sentenced a 47-year-old convict to undergo rigorous imprisonment for 20 years for aggravated sexual assault of a 7-year-old minor girl in 2019.
The convict, identified as Khaidem Bisembor alias Suresh Meitei, is already serving a 20-year rigorous imprisonment for similar offences in a connected case.
On October 12, 2019, Khaidem Bisembor took two minor girls to the site of an under-construction house, and sexually assaulted both of the minors.
Bisembor was arrested and the trials for two separate cases were then initiated against him.
While the current case, the sentence of which was passed today, is connected to the case of the minor, aged 7, the other case that had her friend as the victim concluded recently on November 29.
Hearing the other case on November 29, the same Court had sentenced the convict to undergo rigorous imprisonment for 20 years for aggravated penetrative sexual assault of the minor victim.
In the current case, the Court, today, passed similar sentence under Section 417 IPC (cheating) and Section 6 (aggravated penetrative sexual assault) of POCSO Act, 2012.
In the Court today, Special Public Prosecutor, A Nilachandra submitted that the convict committed the heinous crime against a minor child who was just 7 years old and did not show any human mercy.
The convict deserves maximum punishment as laid down by the law, said the Prosecutor, praying the Court for exemplary punishment that would send a message to the society.
Pleading for leniency, the defence counsel, on the other hand, submitted to the Court that the convict is about 47 and married with two children.
The defence counsel submitted that the convict has been maintaining his family by doing labour works available from time to time.
The children and family members of the convict would suffer for no fault of theirs, said the defence counsel, pleading to the Court to pass a minimum sentence.
The defence counsel further submitted that the convict has been convicted in connection with another case and sentenced to undergo 20 years rigorous imprisonment.
The convict has already spent one year and 11 months in jail, the defence counsel submitted.
The Court, after hearing the submissions, observed that the convict committed the offence while he was still married with an ailing wife.
The Court, after hearing the submission of Special PP and defence counsel, sentenced the convict to undergo rigorous imprisonment of 1 year for offence under Section 417 IPC and 20 years for the offence under Section 6 of POCSO Act, 2012.
Even though the victims are different, the offences were committed on the same day. Considering the plight of the family members of the convict, this subsequent sentence may run concurrently with the previous sentence, said the Court.
The Court also ordered the convict to pay a fine of Rs 1 lakh, and directed the State to pay a compensation of Rs 1.5 lakh to the victim from the victim compensation fund or any other funds or schemes of the Government within a month.
