Man gets lifer for sexual assault of minor

IMPHAL, Dec 23: RK Memcha, Special Judge (POCSO) Fast track Special Court Number 1, Manipur today sentenced a 68-year old man to undergo imprisonment for life for committing sexual assault on a minor girl on different dates and time in the months of October and November 2021 somewhere in Imphal East district under the jurisdiction of Lamlai police station.
The same Court convicted the accused under Section 6 of POCSO Act for committing the heinous crime of sexual assault on the minor victim and fixed today for sentence hearing.
The convict was produced before the Court from Manipur Central Jail, Sajiwa for sentence hearing.
A Nilachandra, Special PP of the State submitted that the convict committed the heinous crime against a minor, then 13 years old, resulting in the delivery of a child.
Saying that the victim is a relative of the convict and the crime he committed challenged all societal norms, the Special PP prayed the Court to award exemplary punishment so as to send a strong message to the society.
On the other hand, the defence counsel of the convict submitted that the convict is now aged 70 years old who needs family care and support and prayed for minimum punishment.
It was also submitted that the convict had already undergone custody from August 7, 2022 till today in connection with the case.
The convict also submitted that he is now aged 70 years and his health is deteriorating and has been in custody since August 7, 2022.
The Court, after hearing the submission of the Special PP, the defence counsel, the convict and on perusal of the material on record, reiterated that the convict committed the offence to his relative, and his criminal act was abuse of trust and authority.
The Court also observed that there is little chance that the convict can be rehabilitated and the offence he committed was very grave, inhuman, unnatural lust and not pardonable in any manner.
Reintegration of the convict into the society or with his family is not appropriate, rather it will cause a chill to the family members including the minor victim, the Court observed.
The Court then sentenced the convict to undergo rigorous imprisonment for life (imprisonment of the remainder of natural life of the convict) and also slapped a fine of Rs 10,000.
The Court order mentioned that the mother of the victim had already been married to another person and the victim was under the care of her father and stepmother.
The Court further directed the State Government to provide Rs 6 lakh to the victim from victim compensation fund or any relevant scheme to the victim as compensation within 30 days.
