AYUSH Directorate issues warning against manufacturing, selling of drugs without license

IMPHAL, Feb 18: Strict legal actions will be taken up against any individuals or firms found manufacturing or selling Ayush and herbal drugs/medicines, AYUSH Director Dr Akoijam Lokendro has warned.
So far, no individual or firm in Manipur has been given license to manufacture or sell Ayush and herbal drugs. Anybody found manufacturing or selling such medicines in Manipur will face strict legal actions, he said, speaking to media persons at his office at Lamphelpat today.
Those who are found advertising such drugs without license on social media platforms including Facebook and YouTube may also attract strict legal actions, he added.
Lokendro said manufacturing and selling of Ayush or herbal drugs without license is prohibited and punishable under 'Drugs and Magic Remedies (Objectionable Advertisement) Act 1954 and The Drugs and Cosmetics Act, 1940.
AYUSH Directorate's Assistant Drug Controller, Dr N Hemanta, who was also present in the press meet, said advertising Ayush and herbal drugs, cosmetic products including eye drops without license on social media platforms, television and newspapers also constitute violations of the Act and rules.
Such advertisements are considered information misleading the public, he added.
Dr Hemanta further informed that there is also an order of the Supreme Court directing the Ministry of AYUSH to take strong action against such violations.
While there has been no complaint yet, the directorate is enforcing the rules and mulling to take strong action against violators, Dr hemanta said.
A person who is found advertising Ayush and herbal drugs or cosmetics without license may be imposed a fine or a jail term of 6 months or both, he said.
Those who are found manufacturing the drugs without license may face a penalty of Rs 20,000 and a jail term of one year. Habitual offenders may face a penalty of Rs 50,000 and a 2-year jail term, he added.
License to manufacture and sell Ayush and herbal medicines/drugs may be availed from the State AYUSH Drug Licensing Authority, he informed.
Pharmacies selling Ayush drugs must also get the license from the State Ayush Drug Licencing Authority, he said.
