POCSO: 60-year-old convict sentenced to undergo 20 years rigorous imprisonment

IMPHAL, May 25: W Tonen, Judge of Fast Track Special Court No II, Manipur, today sentenced 60-year-old convict Naorem Bishambhor to 20 years of rigorous imprisonment for repeatedly sexually assaulting a minor at gunpoint in August 2019.
During the hearing, the convict also pleaded before the Court for a sentence of three to four years with a fine, citing his poor financial condition and responsibilities toward his wife and four children.
Bishambhor, a resident of Tentha Khunjao, was convicted on May 4 and was produced before the Court through video conferencing for the sentence hearing today.
The same Court had convicted him under the POCSO Act for repeatedly committing aggravated penetrative sexual assault under Section 27(1) of the Arms Act for using his licensed .32 pistol during the commission of the offence to criminally intimidate the victim.
Special Public Prosecutor Rakhi Golmei submitted before the Court that crimes against female children are on the rise in society and stressed the need for strict punishment to send a strong message and deter such offences.
She prayed for maximum punishment along with an adequate fine for the offence.
On the other hand, the defence counsel submitted that the convict had no prior criminal antecedents apart from the present case and had fully cooperated during the trial.
The defence sought a minimum sentence.
The convict also pleaded before the Court for a sentence of three to four years with a fine, citing his poor financial condition and responsibilities toward his wife and four children.
He also admitted guilt for the offence.
After hearing the submissions of the Special PP, the defence counsel and the convict, and after considering all the facts, circumstances and mitigating factors of the case, the Court sentenced the convict to 20 years of rigorous imprisonment for repeatedly committing aggravated penetrative sexual assault on the minor victim.
The Court also imposed a fine of Rs 1 lakh, of which Rs 60,000 will be given to the victim for mental trauma, medical expenses and rehabilitation.
In default of payment of the fine, the convict will have to undergo an additional six months of simple imprisonment.
The Court further sentenced the convict to one year of rigorous imprisonment and a fine of Rs 5,000 for criminal intimidation.
He was further sentenced to three years of rigorous imprisonment and fined Rs 5,000 under the Arms Act.
In default of payment of the fines, he will have to undergo an additional one month of simple imprisonment for each offence.
The Court directed that all fine amounts must be paid within six months and ordered that all the sentences will run concurrently.
The Court also directed that a compensation of Rs five lakh be given to the victim by the Government.
