Court sends convict to RI

Imphal, Jul 10: The Fast Track Special Court no 2 on Friday sentenced a 73-year-old man convicted of sexually assaulting a minor girl with disabilities to undergo 20 years of rigorous imprisonment and imposed a fine of Rs. 20,000.
The convict, Md Kora, a resident of Lilong Sangomsang Sukla Karong and presently staying at Lilong Chingkham, was found guilty of sexually assaulting the minor on January 19, 2013.
He was convicted on June 30, 2026.
Pursuant to the Court's direction, the Officer-in-Charge of Lilong Police Station executed the warrant of arrest, and the convict was produced before the Court by a police team for the hearing on sentence.
During the sentencing hearing, Special Public Prosecutor Rakhi Golmei argued that crimes against girl children are increasing in society and that strict punishment is necessary to send a strong deterrent message.
She submitted that sexual assault violates the victim's right to equality, one of the fundamental rights guaranteed under the Constitution of India.
The Special Public Prosecutor further argued that there were no adequate or sufficient grounds for the Court to exercise leniency in favour of the convict.
She urged the Court to award the maximum punishment prescribed under Section 3(a), punishable under Section 4(2) of the Protection of Children from Sexual Offences (POCSO) Act, along with the maximum fine.
On the other hand, the defence counsel pleaded for leniency, claiming that the convict was over 100 years old, in poor health, bedridden for several months, and unable to move without assistance.
The defence also stated that the convict and his family were surviving on the support of relatives and requested the Court to impose the minimum sentence and fine.
The Court also heard the convict, during which he pleaded for mercy.
After considering the aggravating and mitigating circumstances, the Court observed that, according to the charge sheet, the convict was around 60 years old at the time of the offence and is now 73 years old.
Accordingly, the Court sentenced Md Kora to 20 years of rigorous imprisonment and imposed a fine of Rs. 20,000.
In default of payment of the fine, he will undergo an additional six months of simple imprisonment.
The Court further directed that the period already undergone by the convict during the investigation and trial shall be set off against the sentence of imprisonment, as provided under law.
