HC orders CBI to probe Babysana's death case

IMPHAL, Nov 6:  In major breakthrough for the people and the JAC which was constituted in connection with the death of Ningthoujam Babysana, the High Court has allowed the petition filed by the father of the deceased, Ningthoujam Tomchou, for directing the Central Bureau of Investigation (CBI) to probe the case.
The order passed by the Single Bench, High Court of Manipur, headed by Justice MV Muralidaran, directed the investigation (in the file of Singjamei PS and now under investigation by the Special Investigation Team constituted by the State Government) to be entrusted to the CBI immediately.
The order directed the Director of CBI to constitute a team and investigate the matter in accordance with the law and file a report before the Court concerned for further action.
It further instructed the CBI to file a report regarding the progress of the investigation to the Court once a month  and explained that upon receiving the report, the Court will proceed further.
If the CBI feels that a fresh investigation is required into the matter from scratch, they can very well do so and if they feel that continuation of investigation from the stage where the investigation is pending before the SIT will suffice, the CBI is at liberty to start their investigation from that stage as well, the High Court ruled.
The order then directed the SIT to hand over all files relating to the case to the CBI within two weeks and to give full assistance to the CBI in the investigation.
The High Court further made it clear that it has not gone into the merits of the case and the merits of the investigation done so far by the SIT nor expressed its opinion on the merits of such investigation.
It may be mentioned that the petition was filed by Ningthoujam Tomchou as the petitioner praying to the Court to direct the CBI to conduct a prompt inquiry so as to ascertain the exact cause of the death of N Babysana.
It may be mentioned that Ningthoujam Babysana of Thangmeiband Meisnam Leikai was found hung to death inside the hostel of Standard Robarth Hr Secondary School, Canchipur, in the morning of July 18.
