IMPHAL, Jun 29: Special Judge NIA Manipur rejected a bail application filed by Khumlo Abi Anal, one of the accused in the Paraolon ambush case.
The judgement order of the bail application filed by Khumlo Abi Anal alias Ambison (44) s/o (L) Khumlo Khunjo of Lambung village, through his counsel, was announced today after the application was heard on June 26.
During the hearing, the counsel submitted that Khumlo Abi Anal was arrested on June 11, 2015, and he has been in judicial custody till date.
However, the materials produced by the prosecution so far has failed to establish any evidence against him.
It also claimed that NIA and jail authority were quite negligent in providing proper treatment to the petitioner for his illness and he has been languishing in judicial custody for years and further the investigating agency is still arresting new accused individuals and separate charge sheets have been put up against them.
Further detention of Khumlo Abi Anal will cause more infringement of his right to life and personal liberty and as such, the counsel prayed for releasing Khumlo Abi Anal on bail.
On the other hand, Special PP, NIA, contended that the case is related to the killing of 18 army personnel of 6 Dogra Regiment and injuring of 15 other personnel in the ambush which was carried out between Moltuk and Paraolon village, under Tengnoupal district, by a group of around 20 armed cadres of NSCN-K, KYKL, and KCP-N and added that the accused himself is the self styled chairman of NSCN-K for Chandel region.
The Special PP further maintained that on having proper materials against the accused, charges were farmed under section 18 and 20 of the UA(P) Act, and the trial is in the stage of hearing prosecution witnesses and will be completed soon. The Court, after hearing both parties and going through all the records, rejected the bail application filed by Khumlo Abi Anal.
