Bail plea dismissed

IMPHAL, Jul 31 : The Special Court of NIA Manipur dismissed the bail application filed by Sapam Basanta on health ground and directed the SP Sajiwa jail to admit the accused in JNIMS security ward for gall stone surgery.
The decision was announced in an open Court after it was kept reserved on July 29.
Sapam Basanta was arrested in the early part of July 2017 by a team of NIA in connection with the killing of PREPAK ex-chairman N Nongdrenkhomba and his driver inside a quarter at 7th Manipur Rifles campus Khabeisoi, in the intervening night of July 21 and 22, 2016.
During the hearing, counsel of the accused submitted that Basanta is seriously ill inside the jail and in that regard the SP of Sajiwa jail had submitted a medical report which stated that he need to undergo necessary surgery and cardiac care from a well equipped health institute outside the jail. The counsel also pleaded that Basanta be released for some time to avail treatment since no proper treatment is available inside the jail.
The Special PP of the NIA on the other hand submitted that the charges levelled against the accused is of murder under section 302 IPC with criminal conspiracy and common intention which is a heinous offence and till date 2 prosecution witnesses had already been examined before the Court and the trial will be completed within a short period of time. The Special PP further maintained that the ailment mentioned in the medical report can be taken care of inside the jail and if necessary the accused can be treated at JNIMS hospital by keeping him in the security ward of the hospital and prayed to dismiss the prayer of the accused. After going through the material on record as well as the medical report, the Court rejected the bail prayer and directed SP of Sajiwa hail to admit the accused at JNIMS security ward for performing the surgery to remove gall stone.
Court also directed that if there is any delay in releasing the fund by Government for conducting the surgery, the family members of the accused be allowed to bear the necessary expenditure from their side and the same may be reimbursed later.
It may be mentioned that the accused persons who are presently lodged in Manipur Central Jail were arrested by NIA in connection with the murder of PREPAK ex-chairmen Nongdrenkhomba and his driver Leishangthem Sanjit inside the quarter of 7th Manipur Rifle at Khabeisoi on the intervening night of June 21 and 22 in 2016.
